1. Scope of Application: These General Terms and Conditions (hereinafter "T&C") apply to all contracts between M2 IT (Owner: Victor Miller, Freiherr-vom-Stein-StraΓe 5, 76726 Germersheim) and our customers. We only recognize deviating conditions of the customer if we expressly agree to them in writing.
2. Conclusion of Contract: Our offers are non-binding. A contract is only concluded with our written order confirmation or by the actual performance of the service.
3. Prices and Payment Terms: All prices are in Euros. According to Β§ 19 of the German VAT Act (UStG), no VAT is charged. Payment can be made via PayPal, bank transfer (SEPA), cash on site or card payment on site. Invoices are not due immediately. The payment term by agreement is 7, 14 or 30 days, standard 14 days. Cheque payments and set-off of debts between parties are not accepted.
4. Liability: We are liable without limitation only for intentional and grossly negligent breaches of duty. In the case of slight negligence, we are only liable for the breach of essential contractual obligations (so-called cardinal duties) and limited to the typically foreseeable damage. We are only liable for possible data loss if the customer can prove that they have fulfilled their duty of regular data backup.
5. Warranty: The statutory warranty rights apply. Obvious defects must be reported to us in writing within 14 days of service delivery. We provide warranty at our own discretion through repair or replacement.
6. Final Provisions: German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant, a legal entity under public law, or has no general place of jurisdiction in Germany, the place of jurisdiction is Germersheim.
